1. Introduction and Acceptance of Terms

These Terms of Service ("Terms," "Agreement," or "ToS") constitute a legal agreement between you (the "User," "Customer," "you," or "your") and 3R Media, LLC. ("Company," "we," "us," or "our"). By accessing, browsing, or using the VZ Data web application and all associated features, services, and content (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you are using the Service on behalf of a company, organization, or other legal entity (a "Business"), you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, "you" and "your" refer to both the individual user and the entity they represent.

By clicking "I Agree," creating an account, or using the Service in any way, you automatically accept these Terms. If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after modifications constitutes your acceptance of the updated Terms.

2. Eligibility and Account Registration

2.1 Age and Capacity

You represent and warrant that you are at least 18 years old and possess the legal capacity to enter into a binding agreement. If you are under 18, you may only use the Service with the express permission and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

The Service is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that we have collected information from a child under 13, we will take reasonable steps to delete such information and terminate the child's account.

2.2 Account Creation and Responsibility

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials (username, password, and any authentication tokens) and for all activities that occur under your account, whether authorized by you or not.

You agree to:

  • Provide truthful and accurate information during registration
  • Maintain and promptly update your account information
  • Notify us immediately of any unauthorized access to or use of your account
  • Accept full responsibility for all activities conducted through your account
  • Not share your account credentials with third parties

We are not responsible for any unauthorized access to your account resulting from your failure to maintain account security.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or violated applicable laws. Upon termination, your right to use the Service immediately ceases.

3. Service Description and Third-Party Integrations

3.1 Service Overview

VZ Data is a web-based analytics platform designed to help content creators and streamers on Twitch, YouTube Gaming, Kick, Facebook Gaming, and TikTok Live understand and optimize their audience engagement and content performance. The Service provides real-time analytics, performance metrics, audience insights, and trend analysis based on data retrieved from the streaming platforms listed above.

3.2 OAuth 2.0 Authorization

To provide analytics services, the Service uses OAuth 2.0 authorization to connect to your streaming platform accounts. When you authorize the Service to access your account on any streaming platform (Twitch, YouTube, Kick, Facebook, or TikTok), you grant us permission to:

  • Access your public profile information (name, profile picture, follower count)
  • Retrieve analytics data (views, engagement metrics, audience demographics)
  • Access stream information (stream titles, descriptions, stream status)
  • Retrieve audience and engagement data (comments, likes, shares, subscriptions)

Important: We do not receive, store, or have access to your streaming platform passwords. OAuth 2.0 ensures that your credentials remain secure and are never shared with our Service. You maintain full control over what data you authorize us to access and can revoke access at any time through your streaming platform's settings.

3.3 Third-Party Platform Terms

Your use of the Service is subject to the terms of service of each streaming platform you connect (Twitch, YouTube, Kick, Facebook, and TikTok). You agree to comply with all applicable terms, policies, and guidelines of these platforms.

4. User Responsibilities and Acceptable Use

4.1 Acceptable Use Policy

You agree to use the Service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Service. Prohibited behavior includes:

  • Harassing, threatening, or abusing other users
  • Using the Service for illegal activities or to violate any applicable laws
  • Attempting to gain unauthorized access to the Service or its systems
  • Transmitting malware, viruses, or any code of destructive nature
  • Scraping, crawling, or using automated tools to extract data from the Service without authorization
  • Reverse engineering, decompiling, or attempting to discover the source code or underlying technology
  • Impersonating another person or entity
  • Using the Service to create misleading or false analytics data
  • Violating intellectual property rights of the Company or third parties

5. Payment Terms and Billing

5.1 Subscription Plans

The Service offers various subscription plans with different features and pricing. Pricing information is available on our website. All prices are in USD unless otherwise specified.

5.2 Billing and Auto-Renewal

Subscription fees are billed automatically on a monthly or annual basis, depending on your chosen plan. By providing payment information, you authorize us to charge your payment method for the subscription fee and any applicable taxes.

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be notified via email at least 7 days before your subscription renews.

5.3 Refunds and Cancellation

Subscription fees are non-refundable except as required by law. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of your paid period.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL 3R MEDIA, LLC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for all claims arising out of or related to these Terms or your use of the Service shall not exceed the greater of (a) the fees you paid to us in the 12 months preceding the claim, or (b) USD $100.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Before initiating any legal action, you agree to attempt to resolve any dispute informally by contacting us at legal@3rmedia.co with a detailed description of the dispute. We will attempt to resolve the matter within 30 days.
